1.1. Welcome to Derysa ("the App," "we," or "us"). These Terms of Service ("Terms") govern your access to and use of Derysa, our website at https://derysa.xinghe-cloud.com, and related services (collectively, "the Service").
1.2. By creating an account, accessing, or using Derysa, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Service.
1.3. Derysa is operated by Derysa team. References to "Derysa," "we," "us," or "our" include the company, its affiliates, and personnel.
1.4. We may update these Terms from time to time. When we make material changes, we'll notify you through the App or via email. Your continued use of Derysa after such notice constitutes acceptance of the updated Terms.
2.1. By using Derysa, you represent and warrant that:
• You are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher)
• You have the legal capacity to enter into a binding agreement
• You are not located in a country subject to applicable trade sanctions
• You have not been previously banned from using our Service
2.2. Derysa does not knowingly allow users under the required age. If we discover that someone underage has created an account, we will terminate it immediately without notice.
2.3. You are responsible for ensuring your use of Derysa complies with all applicable laws in your jurisdiction.
3.1. To access Derysa's features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
3.2. You are solely responsible for:
• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use or security breach.
3.3. You may not:
• Share your password with anyone.
• Create multiple accounts for disruptive or abusive purposes.
• Transfer your account to another person without our consent.
• Use someone else's account.
3.4. Derysa reserves the right to suspend or terminate your account if any information provided proves inaccurate, false, or incomplete.
You retain ownership of any content you post on Derysa, including photos, profile information, and messages ("User Content"). By posting User Content, you grant Derysa a non-exclusive, worldwide, royalty-free license to:
• Store, display, and distribute your content on the Service.
• Use your content for service improvement and development.
• Share your content with other users as intended by the Service.
This license ends when you delete your content or account, subject to technical limitations and legal requirements for backup retention.
You agree not to post User Content that:
• Is illegal, fraudulent, or deceptive.
• Violates any third-party rights (including intellectual property and privacy rights).
• Is defamatory, obscene, pornographic, or offensive.
• Promotes violence, discrimination, or hatred.
• Contains malware, viruses, or harmful code.
• Harasses, bullies, or threatens others.
• Impersonates any person or entity.
While using Derysa, you agree NOT to:
• Use the Service for any commercial purpose without our written consent.
• Solicit other users for money, transactions, or commercial activities.
• Send spam, unsolicited messages, or promotional content.
• Attempt to manipulate, scrape, or data-mine the Service.
• Interfere with or disrupt the Service or servers.
• Create accounts through automated means or bots.
• Use the Service for any illegal activity, including sex trafficking or exploitation.
• Share sexually explicit content involving minors (we report all such activity to authorities).
• Stalk, harass, or threaten other users.
• Attempt to bypass our verification or security measures.
We have the right, but not the obligation, to monitor User Content and conduct. Derysa reserves the right to:
• Remove any content that violates these Terms.
• Terminate or suspend accounts for violations.
• Take legal action when appropriate.
• Cooperate with law enforcement authorities.
Derysa is a platform for connecting people. You are solely responsible for your interactions with other users. We are not responsible for:
• The conduct of any user, online or offline.
• Disputes, disagreements, or conflicts between users.
• Any outcomes resulting from meetings or communications.
While we strive to maintain a safe community, we cannot verify the identity or background of every user. You should:
• Use caution when sharing personal information.
• Report suspicious behavior immediately.
If you experience harassment, abuse, or suspicious behavior, report it through the App or contact us via Customer Service in the app. We will investigate and take appropriate action.
6.1. Derysa uses location information to show you nearby matches and relevant connections. This feature requires access to your device's location.
6.2. You can disable location services at any time through your device settings, though this may limit certain features.
6.3. By using location-based features, you consent to the collection and use of your location data as described in our Privacy Policy.
The Service, including its design, layout, graphics, logos, and software, is owned by Derysa and protected by intellectual property laws. You may not:
• Copy, modify, or create derivative works of the Service
• Reverse engineer or decompile the App
• Remove any copyright or proprietary notices
• Use our trademarks without written permission
If you provide suggestions, feedback, or ideas about improving Derysa, we may use them without any restriction or compensation to you.
Derysa may offer premium features, virtual goods, or subscriptions ("Paid Services"). All payments are processed through third-party platforms (Google Play Store) and subject to their terms.
Prices for Paid Services are displayed in the App and may change over time. We will notify you of any price changes affecting existing subscriptions.
Refunds are handled by the platform through which you purchased (Google). Derysa does not issue direct refunds for in-app purchases. Please refer to the respective store's refund policy.
Any virtual items purchased have no monetary value and are non-refundable except as required by law. We reserve the right to modify or discontinue virtual goods at any time.
9.1. Derysa may integrate with third-party services (like social media platforms) or contain links to external websites. We are not responsible for the content, privacy practices, or terms of these third parties.
9.2 Your use of third-party services is at your own risk and governed by their terms and policies.
You may delete your account at any time through the App settings. Upon deletion, your profile will no longer be visible, though some information may remain in backups for a limited period as described in our Privacy Policy.
Derysa reserves the right to suspend or terminate your account at any time, with or without notice, for:
• Violation of these Terms.
• Conduct we believe is harmful to the community or our interests.
• Extended inactivity.
• Legal or regulatory requirements.
Upon termination, your right to access the Service ends immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
DERYSA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
• The Service will meet your specific requirements.
• The Service will be uninterrupted, timely, secure, or error-free.
• Any results from using the Service will be accurate or reliable.
• The quality of products, services, or information obtained will meet expectations.
• Any errors will be corrected.
We do not conduct criminal background checks on users or verify the accuracy of user-provided information. You are solely responsible for your interactions.
To the maximum extent permitted by law, in no event shall derysa, its officers, directors, employees, or agents be liable for:
• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or goodwill.
• Damages related to your interactions with other users.
• Any conduct or content of third parties.
• Unauthorized access to or alteration of your transmissions or data.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Derysa, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
• Your use of the Service.
• Your violation of these Terms.
• Your User Content.
• Your interactions with other users.
• Your violation of any rights of another person or entity.
• These Terms, together with our Privacy Policy, constitute the entire agreement between you and Derysa regarding your use of the Service.
• If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely.
• We shall not be liable for any failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, strikes, or government orders.
• By creating an account, you consent to receive electronic communications from us (including emails and in-app notifications). These communications satisfy any legal requirement that communications be in writing.
